Terms of Service

These Terms of Service ("Terms") govern your use of openfitai.com (the "Site") and any order you place on it. They apply alongside our Privacy Policy, Shipping Policy and Refund and Returns Policy. By browsing the Site or buying from it you accept these Terms; if you do not accept them, please do not use the Site.

1. Who you are dealing with

Openfitai is the trading name of SHAMAN DINING LLC, based in COLUMBUS, OH. We sell Home Workout Essentials products online only.

2. Who may use the Site

You must be at least 18 years old, or have the permission of a parent or legal guardian, to order from us. By placing an order you confirm that you meet that condition and that the information you have given — name, address, contact details and payment details — is accurate and complete. Orders containing information we cannot verify may be held or cancelled.

3. Your account

If you create an account, you are responsible for keeping your login details to yourself and for anything done under that login. Tell us at support@openfitai.com straight away if you think someone else has gained access to it.

4. Products and availability

Products are described on their individual pages using the materials, measurements and capacities published for them. Colours may appear differently from one screen to another, and hand-taken measurements carry small tolerances where a listing says so. We may add, change, restock or withdraw any product without notice, and stock is not guaranteed until an order is confirmed.

5. Prices, taxes and errors

Prices are shown in US Dollars (USD) and exclude applicable sales tax unless the page says otherwise. Every cost — product price and tax — appears on the checkout page before you confirm. Prices may change at any time, but a change never affects an order already confirmed. Despite our care, a listing may occasionally carry an incorrect price or description; where that happens we may cancel the affected order and refund it in full rather than fulfil it at the wrong figure.

6. Orders and acceptance

Submitting an order is an offer to buy. It is accepted when we send the shipping confirmation, not when the order confirmation arrives. Until that point we may decline or cancel an order — for example where stock has run out, where a pricing error has occurred, or where a transaction appears fraudulent. If you need to cancel, write to support@openfitai.com as early as you can; an order that is already processed or shipped may not be cancellable.

7. Payment

We accept Shop Pay, Visa, Mastercard, American Express, Discover, Diners Club, Elo, JCB, and UnionPay. Payment is taken securely at checkout through Shopify Payments, which is PCI-DSS compliant, and the connection is SSL-encrypted. Your full card details are never stored by us. There are no hidden fees: what the checkout shows is what is charged.

8. Shipping

We ship to all 50 states of the United States and do not ship internationally. Standard shipping is free on every order with no minimum, and it is the only service offered. Our Shipping Policy carries the processing window, the transit times, the cut-off and the tracking arrangements, and forms part of these Terms.

9. Returns and refunds

Returns are accepted for a manufacturing defect, damage in transit, or a wrong item received. A change of mind or a personal preference is not a ground for return. The full eligibility conditions, the time limits and the procedure are set out in our Refund and Returns Policy, which forms part of these Terms.

10. Intellectual property

The Site and its content — text, product photography, graphics, layout, the Openfitai name and logo — are owned by or licensed to us and protected by copyright, trademark and other intellectual property laws. You may view and print material for your own personal use. You may not copy, republish, distribute, sell or adapt any part of it, or use our name or branding, without our written permission.

11. What you agree not to do

• Use the Site for anything unlawful or fraudulent.
• Interfere with the security, integrity or operation of the Site.
• Scrape, harvest, copy or reproduce Site content by automated means.
• Upload or transmit malicious code of any kind.
• Attempt to gain unauthorised access to any part of the Site, any account, or any connected system.

12. Disclaimer of warranties

The Site and its contents are provided on an "as is" and "as available" basis. We work to keep the information accurate and the Site running, but we do not warrant that it will be uninterrupted, error-free, or free of harmful components, nor that any description is complete for every purpose you may have in mind. Use the equipment we sell sensibly and within the load ratings stated on its page.

13. Limitation of liability

To the fullest extent the law allows, Openfitai and SHAMAN DINING LLC are not liable for indirect, incidental, special, consequential or punitive damages arising out of your use of the Site or of any product bought through it, including lost data, lost revenue and lost profits. Nothing in these Terms limits any liability that cannot lawfully be limited.

14. Indemnity

You agree to indemnify and hold harmless SHAMAN DINING LLC, its officers and its staff against any claim, loss, liability or reasonable cost arising from your breach of these Terms, your misuse of the Site, or your violation of the rights of a third party.

15. Privacy

Your use of the Site is also governed by our Privacy Policy, which explains what personal information we collect, why we hold it and who we share it with.

16. Changes to these Terms

We may update these Terms from time to time. The revised version is posted on this page with a new effective date, and continuing to use the Site after that date means you accept it.

17. Governing law

These Terms are governed by the laws of the State of Ohio and of the United States, without regard to conflict-of-law rules. Any dispute arising from these Terms or from your use of the Site is to be brought before the courts located in State of Ohio.

18. Severability and entire agreement

If any provision of these Terms is held unenforceable, the rest stays in force. Together with the policies referred to above, these Terms are the entire agreement between you and us regarding the Site.
